Limited License

Subject to these Terms of Use, we grant you a non-exclusive, non-transferable, limited right to access, use and display this Site and individual pages from this Site for your own personal, noncommercial use, provided that you agree to and accept without modification the notices, terms and conditions set forth in this Agreement. This authorization is not a transfer of title in any of the products, software, information or materials located on our Site (collectively, “Materials”) and copies of the Materials is subject to the following restrictions: 1) you must retain, on all copies of the Materials downloaded, all copyright and other proprietary notices contained in the Materials; 2) you may not modify the Materials in any way or reproduce or publicly display, perform, or distribute or otherwise use them for any public or commercial purpose; and 3) you must not transfer the Materials to any other person unless you give them notice of, and they agree to accept, the obligations arising under these Terms of Use. Except as expressly provided herein, we do not grant any express or implied right to you under any patents, trademarks, copyrights or trade secret information. In addition, as a condition of your use of this Site, you represent and warrant to us that you will not use this Site for any purpose that is unlawful, immoral or prohibited by applicable law or by this Agreement. Other than this Agreement and agreements between you and DAVTECH relating to the sale of products or services to you through this Site, DAVTECH will not enter into any agreement with you or obligation to you through this Site and no attempt to create such an agreement or obligation will be effective. Use of this Site is unauthorized in any jurisdiction where all or any portion of this Site may violate any legal requirements and you agree not to access this Site in any such jurisdiction. You are responsible for compliance with applicable laws. Any use in contravention of this provision or any provision of this Agreement is at your own risk.

Changes

We may terminate, change, suspend or discontinue any aspect of this Site, including the availability of any features of the Site, at any time. We also may impose limits on certain features and services or restrict your access to all or any part of the Site without notice or liability. We may terminate the authorization, rights and license given above and, upon such termination, you shall immediately destroy all Materials. We reserve the right to change Product pricing, terms, specifications and warranties without notice. We also reserve the right to update or modify these Terms of Use at any time without prior notice and your use following any such change means that you unconditionally agree to follow and are bound by these Terms of Use as changed. For this reason, we encourage you to review these Terms of Use whenever you use this Site.

Orders

While we will make every effort to fulfill all orders, we cannot guarantee the availability of any particular product displayed on this Site. We reserve the right to discontinue the sale of any product or service, to remove any Materials listed on this Site and to change pricing, terms, specifications and warranties at any time without notice. Product prices offered on this Site may vary from other advertised prices due to varying conditions in different geographic markets or distribution channels. The prices displayed on this Site are quoted in CDN dollars, and such prices do not include shipping and handling or sales taxes, if applicable, which will be added to your total invoice price. You are responsible for the payment of any shipping and handling charges and provincial sales taxes that may apply to your order.

Site Security

You are prohibited from violating or attempting to violate the security of the Site, including, without limitation, accessing data not intended for you or logging onto a server or an account which you are not authorized to access; attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to the Site, overloading, "flooding," "spamming," "mailbombing" or "crashing;" sending unsolicited email, including promotions and/or advertising of products or services; or forging any TCP/IP packet header or any part of the header information in any email or newsgroup posting. Violations of system or network security may result in civil or criminal liability. We will investigate occurrences that may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations. You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of this Site or any activity being conducted on this site. You agree, further, not to use or attempt to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search this Site other than the search engine and search agents available from us on this Site and other than generally available third party web browsers (e.g., Netscape Navigator, Microsoft Explorer).

Waiver

Our failure to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision.

Shipping Policy

Our logistics department strives to ship your order within 72 hours (of in stock items). There are times when we are unable to process an order within this time frame; and our sales team will work with you to communicate any unforeseen delays.

• When you submit your order; please ensure that the correct delivery address has been provided.
• All orders will be shipped via Purolator ground service (if Purolator does not service your area we will be shipping your order via Canada Post Expedited Service). We will ship with an alternate carrier upon your request. DAVTECH reserves the right to substitute carriers without notice.
•  All freight charges will be added to your invoice (unless other arrangements have been made)
• Express service is available if required; charges will reflect the faster service and will be added to your invoice.
• We can ship your order collect if you specify your shipping provider and account number when you place your order.
• Freight is NOT discountable.
• All orders ship freight prepaid, F.O.B. Davtech Analytical Services (Canada) Inc. Ownership is transferred at the time of departure from our facility. It is imperative that you inspect your shipment BEFORE accepting delivery. If there is any damage to the package please note it on the bill of lading before your delivery person departs.
• Any claims for errors or defects must be made within 10 days of receipt of goods; you then assume all responsibility for the condition of the goods suitability.
• Freight claims on delivery damage will be handled by Davtech if you can provide a copy of the bill of lading with damage noted on it along with any additional documentation required in resolving the claim (example; photos clearly showing damage to the packaging or product including something to determine the scale; either a ruler or someone’s hand). Failure to follow these guidelines will negate our ability to file a claim on your behalf and will require you to deal with the delivery company directly.
• If Davtech files a claim; you must agree that the negotiated credit is settlement in full proposition.

Purchase Policy

Any claims for errors or defects  must be made within 10 days of receipt of goods. The customer then assumes all responsibility for the condition of the goods and its suitability.

All merchandise shall remain the property of davTECH Analytical Services (Canada) Inc. until paid in full and all cheques have been cleared. Interest of 2% per month (24% per annum) is charged on overdue accounts.

Returns will be subject to a 15% restocking fee – Minimum 25% on Special Orders.

Estimate Policy

The following estimate costs represent our initial findings, there is a chance that the unit will require further parts and/or labour. If this is the case an additional estimate will be supplied.

Equipment Loan Policy

These items are on loan only and will remain the property of DAVTECH at all times.
 Please ensure return of all items after loan period is completed. Any items not returned will be invoiced accordingly.

Customer is responsible for the care and proper operation of the loaned goods while in possession.

Return Policy

In order to ensure that a DAVTECH product continues to operate efficiently and reliably, before use the user should carefully read the Owner’s Handbook or Manual and follow the advice on the safe and correct operation and use of each DAVTECH supplied product. It is recommended that DAVTECH products are installed and/or commissioned by a DAVTECH certified installer. Installation and/or commissioning by persons other than a DAVTECH certified installer may invalidate this warranty.

Returns will be subject to a 15% restocking fee – Minimum 25% on Special Orders.

Standard warranty

Subject to the terms, conditions and limitations in this limited warranty (“warranty”), DAVTECH’s new products are warranted to be free from defects in materials and workmanship for the following period (the “Warranty Period”):

“Date of first purchase” means the date on which the product was purchased by the first retail customer or where the product was installed and/or commissioned by a DAVTECH certified original equipment manufacturer.

“DAVTECH certified original equipment manufacturer”; “DAVTECH National Distributor”; “DAVTECH certified installer” and “DAVTECH certified service agent” are certifications given by DAVTECH. For details of such certified parties, please refer to the DAVTECH.ca online dealer locator.

DAVTECH will (at its sole option) repair or replace any product which is (i) proven to be defective in materials or workmanship; and (ii) returned to DAVTECH (or its agent) during the Warranty Period in accordance with this warranty. Replacement products may be new or refurbished. Such repair or replacement will be the sole remedy by DAVTECH under this warranty. Any repaired or replacement product will be warranted in accordance with this warranty, for the unexpired balance of the Warranty Period on the original product.

Obtaining standard warranty service

To qualify for standard warranty service, the product must be returned to DAVTECH or a DAVTECH certified service agent within: (i) the Warranty Period; and (ii) 30 days of the alleged product failure. The product must be securely packaged and sent pre-paid, accompanied by:

• an original valid proof of purchase confirming the date of purchase and product supplier or a stamped warranty card completed by the product supplier; and
• the product serial number.
• It is recommended that the customer obtains postal insurance for products that are returned under this warranty. DAVTECH will not be liable for loss or damage to products in transit to DAVTECH.

Warranty limitations & exclusions

In addition to any other limitations and exclusions in this warranty, DAVTECH is not responsible for, and this warranty does not cover:

• failure or defects due to accident, abuse or misuse, shipping damage, alterations, corrosion, incorrect and/or non-authorized service or improper installation (whether or not by a DAVTECH certified service agent) or failure to comply with the Owner’s Manual or Handbook;
• products where the serial number has been altered, mutilated or removed;
• costs associated with routine system checkouts, software revisions, alignment/calibration, commissioning unless required by replacement of parts in the area being aligned;
• repair or replacement of consumable items including (without limitation) fuses, batteries, radar mixer diodes etc. A complete list of the consumable items relating to each product can be found in the Owner’s Manual or Handbook
• costs associated with overtime or premium labor work outside normal working hours;
• differences in material, coloring or size that may exist between actual products and the pictures or descriptions of such products in product advertising, literature or on the Internet;  
• replacement of missing components from the package of any product purchased through an Internet online auction site;
•  fees associated with hauling or shipping to a DAVTECH certified service agent;

DAVTECH accepts no responsibility for damage to other equipment, systems or components occasioned by improper or unauthorized connection or use of the product.

Subjecting any DAVTECH product to high pressure washing may cause subsequent water intrusion and failure of the product. DAVTECH will not warranty product subjected to high pressure washing.

Other Conditions

TO THE EXTENT CONSISTENT WITH LAW, THE FOREGOING WARRANTY IS DAVTECH'S SOLE WARRANTY. THE PROVISIONS OF THIS WARRANTY ARE IN LIEU OF ANY OTHER WARRANTY, WHETHER EXPRESSED OR IMPLIED, WRITTEN OR ORAL, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

NONE OF DAVTECH, DAVTECH’S AFFILIATES OR A DAVTECH SERVICE AGENT SHALL BE LIABLE FOR ANY INCIDENTAL, INDIRECT, CONSEQUENTIAL OR SPECIAL (INCLUDING PUNITIVE OR MULTIPLE) DAMAGES, NOR SHALL DAVTECH, DAVTECH’S AFFILIATES OR A DAVTECH SERVICE AGENT BE LIABLE FOR ANY LOSS OF PROFIT, BUSINESS, CONTRACTS, OPPORTUNITY, GOODWILL OR OTHER SIMILAR LOSS. THE LIABILITY OF DAVTECH, ITS AFFILIATES, OR A DAVTECH SERVICE AGENT TO A CUSTOMER UNDER THIS WARRANTY, WHETHER FOR BREACH OF CONTRACT, TORT, BREACH OF STATUTORY DUTY OR OTHERWISE, SHALL NOT EXCEED US$1,000,000. NOTHING IN THIS WARRANTY SHALL LIMIT THE LIABILITY OF DAVTECH, DAVTECH’S AFFILIATES OR A DAVTECH SERVICE AGENT IN RESPECT OF DEATH OR PERSONAL INJURY CAUSED BY ITS NEGLIGENCE, FRAUD OR ANY OTHER LIABILITY WHICH BY LAW CANNOT BE EXCLUDED OR LIMITED.

SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. THIS WARRANTY GIVES A CUSTOMER SPECIFIC LEGAL RIGHTS AND THE CUSTOMER MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM JURISDICTION TO JURISDICTION.

Credit Card Security Code

What is a Card Security Code?
 
The Card Security Code (CSC) is a 3- or 4-digit number printed on your credit card. It provides added security when you use your card on the Internet or over the phone. The number appears only on the card itself, not on receipts or statements.

We ask for the security code CSC when you enter your payment information. This helps ensure that anyone placing an order with DAVTECH has the card in his or her possession and is not using a stolen credit card number.

Each credit card company has a different name for the security code and puts it in a different place.

Turn the card over and look at the signature box. You will find either the entire 16-digit credit card number or just the last 4 digits, followed by the 3-digit CSC.

Look on the card’s back. Printed in the signature box is either the entire 16-digit credit card number or just its last 4 digits. The 3-digit security code follows. On new Visa cards, the code is embedded nearby in the plastic.
